Understanding The Difference

A Buyer’s Agent represents the buyer and is legally bound to act in their best interest.

A Listing Agent is the agent representing the home listing and has a fiduciary duty to the home seller. Any information you provide the agent can be communicated back to the seller giving you a disadvantage unless Dual Agency is involved.

Dual Agency is when the Listing Agent has a written agreement to also represent the buyer equally in the transaction.

It is always in your best interest as a buyer to get an agent who exclusively represents you. Think about it this way: If you were getting sued, would you hire the same attorney as the person suing you? Of course you wouldn’t.
